The inspection procedure
1. The goal of the Inspection Body of BIMEO Ltd., as an organisation conducting inspections, is to run a inspection system, which is approved to be suitable and appropriate on national an European level.
2. Inspecting activities are conducted by the Inspection Body of BIMEO Ltd. according to the designations/registrations mentioned in section 15. of the 18/2008. (XII.3.) SZMM decree. Inspecting activity may be performed by the inspector appointed by the head of the Inspection Body of BIMEO Ltd.. Inspection of the PPEs may be performed by persons who have not take part in the examination and certification procedure of the product in question.
3. The PPE inspecting activities of the Inspection Body of BIMEO Ltd. refers to
a) checking the manufacturing system and the final inspection system guaranteeing the quality of the PPEs of 3. category, according to the contract signed with the manufacturer regarding the compulsory activities to be performed, which takes into account section 15 of the 18/2008. (XII.3.) SZMM decree;
b) checking the manufacturing system and the final inspection system guaranteeing the quality of the PPEs of 1. or 2. category, according to the contract signed with the manufacturer regarding the voluntary inspecting activities, which takes into account section 15 of the 18/2008. (XII.3.) SZMM decree;
The Inspection Body of BIMEO Ltd. performs its above mentioned inspecting activities as an organisation designated by the OMMF according to the 17/2008. (XII.3.) SZMM decree and registered in the EU.

4. The inspection may be required by the consigner through an assignment sent by mail or handed over personally. The consigner will sign a contract with the company, which establishes the rules for the inspection procedure.
4.1. In the case described under point 3. a) the manufacturer of the PPE of 3. category (Hungarian or foreign manufacturer) requests from the designated/registered Inspection Body of BIMEO Ltd. an inspection according to section 15 of the 18/2008. (XII.3.) SZMM decree, (and indicates this fact on the declaration of EC conformity in the requested way). It is advisable to hand in this request before the EC conformity certification procedure for the PPE of 3. category starts, but conformity of the manufacturing system and the final inspection system of the PPE may also be evaluated in the process of accepting the EC type-certificate.
4.1.1. At the request of the manufacturer or its authorised representative, the Inspection Body of BIMEO Ltd. makes an offer for signing a contract regarding the inspecting activity. The contract should fix the documentation which should be provided by the manufacturer, the time schedule for the procedure, the fees to be paid, the checking procedure, the course of invoicing and settling the invoice. The contract should regulate the conditions and circumstances of the checks to be performed by the Inspection Body of BIMEO Ltd., as well as the measures to be taken according to the observations made during the supervision.
4.1.2. During the inspection procedure of the system guaranteeing the quality of the PPE, the Inspection Body of BIMEO Ltd. checks, whether the manufacturer functions a manufacturing process, including the final inspection of PPE, ensures that every PPE complies with the certified protection level (or the protection level to be certified) and the basic requirements of annex 3. of the 18/2008. (XII. 3.) SZMM decree.
4.1.3. The preliminary inspection of the manufacturing system and the final inspection system takes place before requesting the EC type-certificate for the PPE. Exception is when this is requested from the Inspection Body of BIMEO Ltd., when the inspection is performed at the beginning of the conformity certification process. During the validity of the EC type-certificate, follow-up inspections should be carried out at least once a year, at dates randomly chosen.
4.1.4. During the follow-up inspections the Inspection Body of BIMEO Ltd. carries out tests on the PE sample (samples) chosen according to the relevant standards and the documentation of the manufacturing and final inspection system, taking into account the basic requirements of annex 3. of the 18/2008. (XII. 3.) SZMM decree. The Inspection Body of BIMEO Ltd. requests instrumental analysis from a designated/registrated testing organisation. In case the consigner requests the tests from an other designated/registrated testing organisation (eg. the one performing the EC type testing for the given PPE), the test report for the given PPE issued by the chosen testing laboratory should be attached to the assignment. If needed, the proper functioning of the manufacturing and final inspection system is checked during an on-the-spot audit. When questions arise, the Inspection Body of BIMEO Ltd. consults with the organisation which has emitted the EC Type-certificate to unambiguously identify the PPE sample.
4.1.5. The results of the tests are evaluated by the appointed expert of the Inspection Body of BIMEO Ltd., and after the approval of the head of the Inspection Body of BIMEO Ltd. the report is sent to the manufacturer (annex named Inspection report). If the follow-up inspection shows that the manufacturer does not assume its obligations regarding the manufacturing and final inspection system, or the PPE does not fulfill the requirements of the authenticated specimen, the Inspection Body of BIMEO Ltd. takes measures for restoring the protecting level of the PPE. In the scope of these measures
· for minor non-conformities, which does not affect the conformity (safety) parameters of the PPE, the Inspection Body of BIMEO Ltd. calls the manufacturer's attention to their discontinuation;
· when the above mentioned deficiencies are not discontinued, or the PPE shows insufficiencies, which does affect the conformity (safety) parameters and which would make necessary the suspension or the withdrawal of the EC type-certificate, before this step the Inspection Body of BIMEO Ltd. asks the manufacturer, if it wants to maintain the validity of the EC type-certificate, with a deadline of 5 working days. Depending on the answer, the Inspection Body of BIMEO Ltd. informs the designating OMMF, who will take measures for the suspension or the withdrawal of the EC type-certificate by the competent authority of the member state in which the manufacturer has its head office. In case the certificate has been emitted by the Certifying Body of BIMEO Ltd., when informing the designating OMMF, the Certifying Body of BIMEO Ltd. should also be informed.
4.2. In the case described under point 3. a), to maintain a better marketability of the PPE or because of any other reason, the manufacturer of the PPE of 1. or 2. category or its authorised representative asks the Inspection Body of BIMEO Ltd. to make an inspection according to section 15 of the 18/2008. (XII. 3.) SZMM decree, although it is not compulsory for PPEs of this category.
In this case the procedure will be the same as in the case of point a), except the phrase about informing the OMMF. After the manufacturer was informed about the insufficiencies showed by the PPE during the inspection, which does affect the basic conformity (safety) parameters, and the manufacturer gave the answer regarding its intensions with the validity of the EC type-certificate, the OMMF will only be informed in the case of PPEs of 2. category. In the case of PPEs of 1. category the market inspecting FVF should be informed.
5. Appeals, complaints
5.1. Appeal
The Inspection Body of BIMEO Ltd. issues an inspection report which contains all the information showing wether the requirement are met. If the product does not meet the requirements, a list of defects will be issued. If the consigner rejects the information contained in the inspection report an appeal may be put in within 15 days after receipt. The time limit for judgment of appeals is 10 days.
The appeal is passed by the head of the Inspection Body to the managing director, who will judge the case. The managing director will study the documents, and makes a decision taking into account the documentation attached to the appeal and the opinions of those persons who has take part in the previous decision making. The decision is put down in writing. On the basis of the decision the Inspection Body of BIMEO Ltd. takes the necessary measures and informs the consigner about the facts. If the consigner does not want to accept the decision made on the appeal neither, a civil action may be initiated against the Inspection Body of BIMEO Ltd..
5.2. Complaints
An appeal may be put in within 15 days after the completion of the services. Complaints should be put on the record. The record should contain the data of the person or company handing in the complaint, the detailed description of the complaint. The head of the Inspection Body makes a decision wether to accept the complaint or to reject it. In case of complaints where many areas are concerned, the managing director will also take part in the decision making. The consigner should be informed about the acceptance or rejection of the complaint within 15 days after the notice.
The head of the Inspection Body takes a decision about the way in which the complaint should be settle, appointing a person in charge for the arrangements. This person puts in writing the measures taken and attaches it to the documentation. In the same time the head of the Inspection Body takes correcting measures regarding the complaint, and puts it in writing in the complaint record, marking the name of the person in charge and the deadline as well. After the deadline he supervises the correcting activities made, and records the results in the record. In case the complaint is rejected by the head of the Inspection Body, a common way of settling the case should be found together with the consigner. In case the consigner initiates a civil action because of the rejection, measures should be taken according to the judgment of the court.
In case of constantly repeated complaints, the managing director orders an extraordinary internal audit.
